Superior Court Denies Injunction for Croydon Students

croydon village schoolGood news for the Croydon School District. In a letter dated December 14, Judge Brian Tucker denied the NH Board of Education a preliminary injunction for Croydon to remove their students from the private Newport Montessori School and place them in a public school.

In the ruling, Judge Tucker wrote the State Board of Education failed to show irreparable harm to grant the injunction by:

1.The commissioner’s decision not to seek an injunction in February 2015 and permitting public school students to complete the school year in the private schools

  1. Affidavits filed on probable adverse effects on students who would be uprooted from the Montessori school in the middle of a school year.

The decision was not on the merits of the parties’ legal arguments. A tentative hearing date on the merits of the law is slated for January 13, 2016.
