Good news for the Croydon School District. In a letter dated December 14, Judge Brian Tucker denied the NH Board of Education a preliminary injunction for Croydon to remove their students from the private Newport Montessori School and place them in a public school.
In the ruling, Judge Tucker wrote the State Board of Education failed to show irreparable harm to grant the injunction by:
1.The commissioner’s decision not to seek an injunction in February 2015 and permitting public school students to complete the school year in the private schools
- Affidavits filed on probable adverse effects on students who would be uprooted from the Montessori school in the middle of a school year.
The decision was not on the merits of the parties’ legal arguments. A tentative hearing date on the merits of the law is slated for January 13, 2016.
